1. Definitions
In these terms and conditions:
- "Kestrel Ledger", "we", "us", "our" refers to the business operating under that name at Level 21, Menara Binjai, 2 Jalan Binjai, 50450 Kuala Lumpur, Malaysia.
- "Service" refers to any of the three offerings described on our website: the Retirement Records Organisation Session, the Paperwork Preparation Support engagement, and the Retirement Information Workshop Series.
- "Client", "you", "your" refers to any individual or organisation that engages Kestrel Ledger for a Service.
- "Agreement" refers to these terms and conditions together with any service-specific arrangement confirmed in writing.
2. Acceptance of Terms
By booking a Service or submitting an enquiry through our website, you confirm that you are at least 18 years old, that you have the legal capacity to enter into this Agreement, and that you accept these terms in full. If you are booking on behalf of an organisation, you confirm that you are authorised to bind that organisation to these terms.
3. Service Description and Scope
Kestrel Ledger provides administrative and informational support in relation to retirement-related documentation. Our Services cover:
- Sorting, cataloguing, scanning, and filing retirement documents (Organisation Session)
- Assisting with the practical completion of official forms and assembly of supporting documents (Preparation Support)
- Delivering group education sessions on retirement records and document-keeping (Workshop Series)
Our Services do not include legal advice, financial advice, representation before any authority, or any opinion on individual entitlements, eligibility, or benefit amounts. Where a question falls outside our scope, we will direct you to the appropriate official channel or professional.
Services are available primarily in Kuala Lumpur and the Klang Valley. Off-site sessions beyond this area may incur a travel supplement, which will be agreed in writing before the session.
4. Booking and Confirmation
A Service booking is confirmed when we send you a written confirmation (by email or letter). We reserve the right to decline a booking if the Service is not suitable for your situation. Bookings for the Workshop Series require a minimum deposit of 30% of the total fee, payable within seven days of booking confirmation.
5. Client Responsibilities
You agree to:
- Bring all relevant documents to the session or make them available at the agreed location
- Provide accurate personal information when booking and during the session
- Not use Kestrel Ledger's involvement in a submission as a statement of endorsement, professional certification, or legal validation of the documents
- Direct any entitlement, eligibility, or advice questions to the appropriate authority or professional
6. Intellectual Property
All workbooks, checklists, glossaries, and written materials produced by Kestrel Ledger remain our intellectual property. Clients receive a personal, non-transferable licence to use these materials for their own retirement planning purposes. Materials may not be reproduced, sold, or distributed without our written consent.
7. Payment Terms
Fees are stated in Malaysian Ringgit (MYR) and are inclusive of all materials specified for each Service. Payment is accepted by bank transfer to our business account or by card at the office. Full payment for the Organisation Session and Preparation Support engagement is due no later than the date of the first appointment. For the Workshop Series, the balance after the deposit is due before the first session.
Cancellation and rescheduling: Sessions cancelled with more than five working days' notice may be rescheduled without charge. Sessions cancelled with five or fewer working days' notice will incur a cancellation fee of 30% of the session fee. Sessions cancelled on the day will be charged in full. We will endeavour to reschedule at no charge where the cancellation is due to circumstances outside your control.
8. Confidentiality
We will not disclose the contents of your documents or personal information to any third party except where required by Malaysian law or a lawful order. Document scans are deleted from our systems within 30 days of session completion unless you provide written consent to retain them. Our confidentiality obligations survive the termination of this Agreement.
9. Disclaimers
Our Services are provided on an "as available" basis. We do not warrant that any submission assembled with our assistance will be accepted by the receiving authority, as acceptance depends on factors outside our control including the completeness of the documents you provide and the policies of the receiving office at the time of submission.
Nothing in our Services constitutes legal advice, financial advice, or a professional opinion on your individual circumstances. We recommend that you consult a qualified professional for any matter that requires such advice.
10. Limitation of Liability
To the extent permitted by Malaysian law, Kestrel Ledger's liability for any claim arising from a Service is limited to the fee paid for that Service. We are not liable for indirect, consequential, or special losses, including loss of income, loss of benefit entitlement, or costs arising from a submission being delayed or declined.
We are not liable for losses arising from events outside our reasonable control, including natural disasters, government actions, or failure of third-party digital services.
11. Indemnification
You agree to indemnify Kestrel Ledger against any claims, losses, or costs (including reasonable legal fees) arising from your breach of these terms, your misrepresentation of facts during a session, or your use of our materials in a way that exceeds the licence granted in clause 6.
12. Termination
Either party may terminate a Service engagement with written notice. If we terminate, we will refund a pro-rata portion of any prepaid fee for sessions not yet delivered. If you terminate after sessions have begun, the cancellation terms in clause 7 apply to any outstanding sessions.
13. Dispute Resolution
These terms are governed by the laws of Malaysia. In the event of a dispute, we ask that you contact us first at [email protected] to allow an opportunity to resolve the matter informally. If informal resolution is not possible, disputes will be referred to the courts of Malaysia with jurisdiction in Kuala Lumpur.
14. General Provisions
- Entire agreement: These terms, together with any written service confirmation, constitute the entire agreement between the parties.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any term on one occasion does not constitute a waiver of that term.
- Assignment: You may not transfer your rights under this Agreement without our written consent. We may transfer our obligations to a successor business.
- Notices: Formal notices under this Agreement should be sent by email to [email protected] or by post to our registered office address.
15. Changes to These Terms
We may update these terms from time to time. The date at the top of this page shows when they were last revised. Continued use of our Services after an update constitutes acceptance of the revised terms. For ongoing engagements, material changes will be notified to you by email before taking effect.
